  2. About eight years ago, my uncle, Joseph McCormack, Shinglass, Ballymore was going up to my mother's house one evening. A gate leads from the road to the boreen on which my mother lives. The gate was a wooden one and was secured to the post by means of a chain.
    When my uncle entered the boreen he shut the gate and fastened the chain. He had not gone far when he heard the chain fall and the gate swing open. Thinking he had not fastened it properly
