Cape Clear Stewart jumped overboard and swam to a fishing boat. The story he told there not being believed, he was taken ashore and handed to the police. In the meantime the "Mary Russell" and her escort arrived at Queenstown Harbour and the news spread like wildfire.
Captain Stewart was brought to Cork gaol and later tried and found to be insane and was sent to a Lunatic Asylum in Cork, where after 26 years of varying emotions he died, and was buried amongst his crew at Oldchurch, Passage West.

Inscription on tombstone. Oldchurch, Passage West.
You gentle readers that pass this way,
Attend awhile adhere to what I say,
By murder vile, I was bereft of life,
And parted from two lovely babes and a wife.
By Captain Stewart I met an early doom,
On board the "Mary Russell" the 23rd of June,
Forced from this world to meet my God on high,
With whom I hope to reign eternally Amen.
